Ghana Needs a Robust Legal Framework to Combat Misinformation – Penplusbytes

Penplusbytes, a non-profit organization in the media sector, is advocating for a review of Ghana’s laws to effectively combat misinformation and disinformation, which are currently seen as insufficient.

The organization proposes strengthening the Right to Information Act of 2019 to ensure timely access to information, helping to reduce the spread of false information.

According to Professor Abena Yeboah-Banin, the Lead Researcher, many existing laws, including the Criminal Offences Act of 1960 and the Electronic Communications Act of 2008, were not designed to address the modern challenges posed by misinformation.

While presenting her study findings at a multi-stakeholder conference on Fighting Misinformation and Disinformation in Accra on Friday, April 11, 2025, she reiterated the need for a comprehensive review of current laws to tackle the unique obstacles of online misinformation.

Additionally, she emphasized the importance of enhancing the implementation of the Right to Information Act to ensure timely disclosure of information.

Professor Yeboah-Banin also proposed establishing a non-partisan body to oversee cases of misinformation and disinformation, ensuring impartial evaluations.

Regarding media literacy, she called for more programs focused on improving media and digital literacy to empower individuals to identify and discern misinformation.

Meanwhile, the Minister of State for Public Sector Reforms, Madam Lydia Lamisi Akanvariba, expressed the government’s commitment to combating misinformation and disinformation.

She highlighted ongoing efforts to enhance transparency and accountability, citing initiatives such as publishing budget and expenditure data online and strengthening relevant institutions.

Penplusbytes’ call to action emphasizes the need for a comprehensive approach to addressing misinformation while balancing regulation with freedom of expression.
