Former judge sues Judicial Service, Chief Justice and Attorney General over dismissal

Former Jasikan Circuit Court Judge, Alfred Kwabena Asiedu, who was dismissed over alleged misconduct, has initiated legal proceedings against the Judicial Service, Chief Justice Her Ladyship Justice Gertrude Torkornoo, and the Attorney General.

This comes after he was dismissed by the Chief Justice for allegedly abusing his power and sexually exploiting a client who came to his court for legal redress.

Initially refuting the accusations as products of the petitioner’s imagination, Mr Asiedu is now petitioning the court to declare his removal from office as ‘unlawful.’

Among the reliefs being sought, Mr Asiedu requests a declaration that his removal from office, as outlined in the letter dated November 13, 2023, signed by the 2nd Respondent (Chief Justice), is unlawful.

Additionally, he seeks declarations asserting that both the Disciplinary Committee and the Judicial Council exceeded their authority in finding him guilty of malicious prosecution.

He contends that these findings constitute a patent error of law on the record, and should be quashed by the supervisory powers of the court.

 

 

Background

The controversy began when Singari Diana Sadia petitioned the Chief Justice on January 16, accusing Judge Asiedu of abuse of power, sexual exploitation, malicious prosecution, and impropriety in a divorce case.

The petition was subsequently transferred to the disciplinary committee of the Judiciary Service, which conducted an investigation and recommended the judge’s dismissal.

In response to the disciplinary findings, a letter from Chief Justice Torkornoo directed Judge Asiedu to surrender all official properties, including his official vehicle, dockets, and record books, to the Judicial Secretary.
